Who is the seller behind an order placed here?

Every order on missfittribe.com is a contract with MELISSA NICOLE VARELA FUNY LLC, a limited liability company with its business address in Chandler, Arizona, and these terms cover each visit to the site and each order placed through it.

The seller for every order

MissFitTribe is the name under which MELISSA NICOLE VARELA FUNY LLC, EIN 99-4915860, sells its sweaters, and the company’s business address is 3778 E Libra Pl, Chandler, AZ 85249, United States, so any reference here to the store, the seller or MissFitTribe means that company.

Prices for sweaters and shipping

Every price is in United States dollars and may change without notice, although the price on the checkout page at the moment you pay is the one that binds that order, together with a shipping charge of $6.00 below $119.00 or $0.00 from $119.00 and the sales tax for the delivery address. Obvious pricing errors are handled as described in the Payment Policy.

Listing details for each sweater

Each listing describes its sweater with the maker’s measurements in inches and centimeters, its fiber content and its care notes, and the Size Guide explains how to read those charts, since a knitted garment can differ slightly from its chart within the maker’s tolerance, which reaches 3-5 cm on the hand-measured MFT-CD-010.

Contract formation for an order

An order you place is an offer to purchase, and the contract forms when the confirmation email with the order number is sent, after which the store can still cancel an order for a pricing error, a failed fraud check or a size that cannot be supplied, always with a full refund.

Payment timing for each order

The whole amount due comes out of your card or PayPal account in a single charge when you place the order. Accepted methods and the steps after a failed payment are listed in the Payment Policy.

Cancellation rights for a new order

You may cancel for 24 hours after placing an order, as long as dispatch has not happened, and receive a full refund within 2 business days from the cancellation, whereas a dispatched order follows the Refund and Returns Policy.

Separate policies for shipping and returns

Two other pages belong to these terms as well: the Shipping Policy, which sets where sweaters go, how fast they travel and what delivery costs, and the Refund and Returns Policy, which sets the 30-day window and how refunds work.

Age and use requirements for buyers

Orders are accepted from buyers aged 18 or older and for personal use, which means buying sweaters in quantity for resale is not permitted under these terms.

Acceptable use for the website

The site may not be used to break the law, copy its content in bulk, probe its security or order in another person’s name without permission, and an account or order tied to that kind of use can be canceled, with any payment refunded.

Ownership rules for text, logo and photos

The site’s text, layout and the MissFitTribe name belong to MELISSA NICOLE VARELA FUNY LLC, product photos and measurements come from the sweaters’ makers and remain theirs, and none of this material may be reused without written permission.

Reviews for verified buyers

A product review can be posted only by a customer whose purchase of that sweater is verified, reviews appear without edits apart from removing personal details or offensive language, and the store neither pays for reviews nor writes them.

Warranties for the sweaters

Each sweater is sold as its listing describes it and no further warranty is added, but implied warranties that state law does not let a seller exclude, such as the warranty of merchantability, stay in place, in line with the Disclaimer.

Limits on liability for a claim

Where the law permits a cap, the company’s liability for a claim tied to an order is capped at what was paid for that order, so a single MFT-TN-001 bought for $57.99 plus tax carries a cap of exactly that amount, and indirect losses such as lost time are not covered.

Indemnity for misuse of the site

You agree to pay the reasonable cost of any claim brought against the company because of something you did on the site in breach of these terms, legal fees included, as far as the law allows.

Events beyond control for either party

Neither side answers for delays caused by events outside reasonable control, such as severe storms, carrier shutdowns, power outages or government orders, and in those cases the shipping and refund rules in the policies still decide what happens to the order.

Informal resolution for disputes

Both sides agree to spend 30 days from the first written notice trying to settle a dispute by email before any court filing, there is no arbitration clause in these terms, and small claims court stays open to you at all times.

Governing law and courts for these terms

Arizona law governs these terms. A lawsuit about them belongs in an Arizona state court in Maricopa County or in the U.S. District Court for the District of Arizona, and any consumer protection law of your home state that cannot be waived still applies.

Links to outside sites for convenience

Outside websites reached through links here, carriers and PayPal among them, are offered as a convenience and are governed by their own terms.

Severability for any invalid clause

Should a court find a clause invalid, that clause is narrowed or removed, and every other part of these terms keeps its full effect.

The entire agreement for an order

These terms, the policies linked on this page and the order confirmation together make up the whole agreement for an order and replace any earlier statement about it.

Changes for future orders

Updated terms apply to orders placed on or after the effective date at the top, and an order placed earlier follows the version that was in force on its order day.
